Terms of Service

1. Acceptance of Terms
By accessing or using LoyalMT (“the Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these terms.
2. Description of Service
LoyalMT provides a digital loyalty card platform that allows businesses to create and manage loyalty programs (stamp cards, points programs, and prepaid credit) for their customers. The Service includes a business dashboard, QR code scanning, customer management, and analytics.
3. Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.
You must provide accurate and complete information during registration and keep your account information up to date.
4. Subscription Plans & Billing
LoyalMT offers a free plan and paid subscription plans (Starter and Growth). Paid plans are billed monthly via Stripe. By subscribing to a paid plan, you authorise us to charge your payment method on a recurring basis.
You may upgrade, downgrade, or cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial months.
We reserve the right to change pricing with 30 days’ notice. Existing subscribers will be notified before any price change takes effect.
5. Plan Limits
Each plan has limits on the number of loyalty programs and members. If you exceed your plan limits, you will need to upgrade to continue adding programs or members. We will not delete existing data if you downgrade, but you may not be able to create new programs or accept new members until you are within the limits of your current plan.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Upload malicious code or content
- Use the Service to send spam or unsolicited communications
- Resell or redistribute the Service without our written consent
7. Intellectual Property
The Service, including its design, features, and content, is owned by LoyalMT and protected by copyright and other intellectual property laws. You retain ownership of the content and data you upload to the Service.
8. Data & Privacy
Your use of the Service is also governed by our Privacy Policy and GDPR Policy. As a business using LoyalMT, you are the data controller for your customers’ personal data, and we act as the data processor.
9. Limitation of Liability
To the maximum extent permitted by law, LoyalMT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.
Our total liability for any claims arising under these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your account if you violate these terms or if your account has been inactive for an extended period. You may delete your account at any time through the dashboard settings.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.
12. Governing Law
These Terms are governed by the laws of Malta. Any disputes shall be resolved in the courts of Malta.
